When To Seek Legal Guidance

Family law issues often involve sensitive matters that may require the guidance of an experienced attorney who understands Indiana law. As such, if you are facing a divorce, child custody dispute, child support matter, paternity action, parenting time disagreement or any other family-related legal issue, it is wise to seek early legal guidance.

As a reputable family law attorney in Richmond, I can assist you in navigating these complex matters. My goal is to provide you with practical guidance and help you pursue a resolution that protects your interests.

Procedures For Family Law Cases In Indiana Courts

Indiana’s many counties, including Wayne County, require family disputes to be resolved through mediation before litigation.

The process typically begins when one party files the petition with the court. If you are filing for divorce, the law requires that you or your spouse have lived in Indiana for six months and in the county you are filing in for at least three months. Once you file the petition, you must formally serve the respondent with the relevant documents. Afterward, they generally have 20 days to file a written response or counter-petition with the court.

For stability, you can request temporary orders addressing issues such as child custody, child support or alimony while the case remains pending. After the discovery process, where you exchange financial and other information, you can get into mediation. If you reach an agreement, you can submit it to the court for approval.

However, if you cannot reach an agreement, the case proceeds to a final hearing where you present evidence and the judge issues a final order. When making decisions involving children, Indiana courts focus on the best interests of the child. On the other hand, child support is generally calculated using Indiana’s Child Support Guidelines. I can work closely with you to pursue solutions that support your goals.

How To Prepare For A Family Law Case In Indiana

Start by gathering and organizing relevant documents such as financial records, which serve as critical evidence. If children are involved, school records, medical records, copies of emails and text messages may be required.

It is also good to consult an attorney to understand the legal standards and set realistic expectations. As your Richmond family lawyer, I can guide you through every stage so that you can navigate the process with confidence.

Solutions That Are Tailored To Fit Your Needs

I will always listen carefully to the details of what you want to accomplish. I then tailor my legal services to fit your needs. You will receive honest answers to your questions and realistic assessments of your chances for success. I negotiate persuasively and, if necessary, litigate aggressively in your best interests.
